Law regarding child custody

I have not filed for divorce, nor has my wife. She has our three year old son living with her. I want him to live with me until the divorce and custody is worked out. I am afraid I won't see him. Can I just take him as long as I let her know where he will be, and provide address and phone number? Or is that kidnapping? He's my son too, and I want to see him. LegalAid can't help me and I don't know how to get a lawyer with my limited income.

You need a temporary custody/parenting time order. Just taking your son as you describe can get you in serious trouble. You will have to re-think your spending priorities and come up with a plan, I believe.

Until a court order says otherwise, you have equal rights to your son. You need to protect those rights by getting an experienced divorce attorney.
