Legal Question in Family Law in Michigan

Marital home keeping me in marriage

My home is in very bad shape - water damage, etc. And my husband is hording computer junk in the basement - it's FULL of junk. I have a disability and can not fix the place up myself and I don't think we could sell it for what we owe.

I need to go forward with a divorce due to my husbands mental state AND I need full custody of the kids. How can I go about this without filing bankrupt? I do have a decent job, but we have very little savings and I don't know how to go about the divorce and provide my two children with a reasonable home.

I was told last year by a lawyer to stay because I couldn't afford to do this, but staying is not an option anymore.

I suggest contacting a family law lawyer who can handle your divorce and all of the related issues with your living situation. If you husband is mentally incapacitated, he will have to be placed into a home and DHS will likely have to get involved. You need to figure out your living situation and then focus on bankruptcy.

Do not stay simply due to financial reasons - your health and happiness is much more important.
