Marital Property

I have been married to my wife for 13 months. She came into the marriage with no assets. I own my home a few cars (1 bought during the marriage, but still in my name not hers). Her name is not on anything other than a joint bank account that has limited funds. My question is this: Is she entitled to any of my assets including my home, cars, sep. bank accounts? I did not add her name to any of my assets. I may also add that she did not work during our marriage and did not contribute financially at all. In fact I had asked her to work during this time, which she refused. She has since taken one of my vehicles and left the state. I have told her I want the vehicle back, but she seems to think she is entitled to this vehicle. The vehicle is in my name and I make the payments. Would this not be considered stolen? Hello, I have received a copy of your posting. The "technical" answer is that your assets would be reviewed to determine if they were "marital assets". All "marital assets" would be considered as subject to division between the husband and wife. The "practical" answer is that in this short of a marriage you would each be awarded what you brought into the marriage. Your wife would, at best, be entitled to one half of the increase in the equity of the marital home or the value of other assets that occured during the marriage. That is her "best case" scenario. Her "worst case" scenario is that she gets nothing since she brought nothing into the marriage. I can't answer your question about whether the car has been "stolen". Given the length of this short marriage and that the assets were owned by you prior to the marriage. She probably does not have a claim to any of the assets including the autos. I file for divorce and report the car stolen. For more info, please contact my office at (248)851-3171.

It is not stolen as she had legal access to it. See a divorce lawyer and let him or her deal with it. Otherwise, what are you going to do about it? See a lawyer. William S. Stern 248-353-9400
