Legal Question in Family Law in Michigan

Marriage in India Divorce in U.S

I got married in 2007 in India. We stayed together with my parents after marriage for 5 months, then he left to U.S on H1B.I was in India and came to U.s on H1B in november 2008. He stays in California and I stay in Michigan. Since marriage we both had difference of opinion.I want to seek divorce but he is threatening he wont accept for this. He wants to stay in u.s and wants me to support him financially if he loses job. We dont have children and I dont want any financial support from him. Is there any possible way to seek divorce in u.s even if he dont accept? What if he leaves to india after applying divorce? Will that divorce be valid if he is india and i stay in u.s?

Re: Marriage in India Divorce in U.S

You will want to see an attorney that is knowledgeable about how India's marriages are recognized in the US, but as far as Michigan is concerned (and most any other state as far as I know), you do not need the spouse's permission to get divorced, you can proceed with divorce proceedings. It might take some time to get the divorce granted, but it will be granted.
