Married and wants to leave w/ children!

I am Married and have 4 children the marriage is a mess but I now feel I've had enough of the fighting, cheating and all the mental abuse. I thought if we got married it would change him and he would be faithful but he still gets himself in mixed up in relationships and he gets in trouble with the law. Well I want to move out but not just out of the house but also out of Michigan, and I want to take my kids with me. Can I even if he doesn't want me to? I will still allow him to see our children he is good to them. But can I leave with them as long as he knows where and can see the kids?

Right now, there is no court order preventing you from leaving so you can do as you please. However, you must establish some amount of residency in another state before you can file for divorce in that other state. This means that your husband will have a fair amount of time to file in Michigan and get an order requiring return of the children. You also could file in Michigan but most likely there would be some type of order requiring the kids to remain in Michigan. As a matter of fact, it is routinely included in orders as there is a statute concerning removal of the children. Your best bet is to get a lawyer here to take care of things for you, file for divorce, etc. The usual problem with people in your position is financial. Years of problems result in tremendous legal complications but people do not leave themselves the resources to help themselves.
