Minors

Is there any way a child can choose to live with another family member if one parent is dead and proof can be shown that the child was taken care of by that family member rather than the surviving parent?

Yes, but you'd have to petition the court for guardianship of the minor and give notice to all interested persons (as defined under the law). There would be a hearing and the court would decide whether the proposed guardian is suitable, etc., or may award guardianship on a temporary basis, depending on the circumstances. There are several factors that the courts consider when determine guardianship issues. The child might also need a new conservatorship to handle its financial affairs, if it has any money, etc.
