Moving out of the country

My son is 14 and wants to move to Australia with me. My ex and I have joint custody. He does not want him to go. Does he have any say when my son is 14? If so, at what age will my son have to be to be able to move without his dads consent?

While the Court might listen to your son's preference, your ex still has a say-so in it. The best thing to do is to file a Motion with the Court asking for an Order allowing the move. Good luck.

Your son will never be allowed to move wtih you without the court's consent until he is 19 1/2 or graduates from high school. It is quite a distance so you'd need a real good reason as your move would basically destroy his visitation, unless you are willing to pay for the plane fare. William S. Stern
