Legal Question in Family Law in Michigan

Quit Claim Deeds on personal property

I signed a quit claim deed on my home due to divorce. My mistake..did not get my name removed from title before doing this. #1 how liable am I if ex defaults? #2 Can mtg. co. go after my IRA's? #3 If I re-marry, would new spouse then also become liable for this mtg? #4 I cannot get my ex to remove my name from title. Have offered to pay for it! How can I get this done without him?

Re: Quit Claim Deeds on personal property

Yes, you are still liable for the mortage, but your new husband would not be held financially responsible. Your IRA is protected from a judgment if one results.

It sounds like you were not represented by an attorney. This is why a non-attorney or even an attorney should not represent him or herself. If you had an attorney, this would likely not have happened. If you did have an attorney, you need to contact that attorney immediately and have this problem fixed. I advise you to spend some money now on an attorney to get this fixed if you did not have a divorce attorney.
