Legal Question in Family Law in Michigan

unwed fathers rights

My brother is living with a gal. They have a child together. When they argue she threatens to take the child and run. What are his legal rights when it comes to unwed fathers? He would like to know. He wants to see his child or keep it if they brake up. He is not a teenager, he is 30+. Thank you.

He has the right to keep her in state. He should see an attorney. The attorney could get them both in and work out an arrangement to put in a court order the rights and obligations of the parties. If she runs, she would be guilty of parental kidnapping.

First, if he hasn't already done so, he needs to establish paternity ( that he is the father of the child). Then, he could seek from the court either a custody or parenting time order. Either order would protect his rights. He should contact the local bar association in the County where he lives for referrals of potential attorneys, providing he could afford to do so. If he is unable to retain an attorney due to his financial condition he may qualify for free legal assistance from legal aid. There are also some support groups around Michigan especially for men that may be able to assist him in Pro Per proceedings.
