Legal Question in Family Law in Michigan

videotapping phone conversations

My husbands ex-wife is taking him back to court because she says that while his daughter is with him his 40 days out of the year that she isn't allowed to call her mother. We have taken pictures of the phone showing that she has been talking and for how long. We have also been videotapping his daughter to show that she really doesn't want to talk to her mom. She has told her mom on numerous occasions that she doesn't walk to talk, but her mother insists we make her talk anyway. Her mother lives in GA and we live in MI. We were wondering if this was legal and legite to use in court. The phone is on speaker every time they talk. We are doing it more to show that she really doesn't want to talk to her mom. There is audio and we don't tell her mom that we are doing it.
