Legal Question in Family Law in Michigan

visitation hearing regaurding our son

We live in Michigan, My wife and her son moved from California in Nov, 2004. Her X didnt show for any of the divorce hearings, never even expressed concern as to his sons leaving the state or about visitations. Now he has decided he wants to see his son. He has threatened to take his son and run if he ever gets to see him, and is promising his son every weekend at Disneyworld and so on. Can we legally listen to their phone calls? At this point , we are concerned Our Son will want to run away or even lie to be with his father and the sweet life he promises.

Since our sons father decided to ask for visitation and legal /joint custody, he has been calling, and sending money. He has not called in almost 2 yrs prior to this and his son didnt want to talk to his father either. We did encourage their communication, however our son didnt want anything to do with his father.

We cant give him disneyland every weekend, and he has chores and has to respect others and so on, school is extremely important of course, can you imagine a 13 yr old being told he can have the world and making a choice ? lemons or cotton candy? How can we stop this brainwashing or at least stay informed ''by listening in'' and being prepared at the hearings?tyvm

You should certainly hire an experienced and aggressive family law attorney to fight for you and your family. Court order can be put in place to prevent the sort of conduct that the ex is showing.
