Legal Question in Medical Leave in Michigan

Intermitten fmla

I was on intermitten FMLA because

of my wife (surgery and mental issues) and my newborn baby. My

fmla papers says I have one year

of this status. My employer is now

saying that instead of her asking every 30 Days of the status of leave

she just gives us 6 months and she

then cancels the fmla of the employee.. I assumed that you have one year of this status. I was

never given any notification of the

changes she was making. I have 256 leave credits availabel. I wasn't

told to recertify for fmla by personnel at all. I used fmla status

to tend to my wife for 2 days and I

received lost time from my employer. When my employer told me I had received lost time was when personnel told me of the changes that had taken place. I

was blindsided. I'm a State of Mich. eemployee. What are my options??

This needs clarification with the personnel department.

Get all the documentation of the state FMLA-related policy, read it, then sit down with someone BEFORE your time runs out and figure out exactly what their position is and where you stand. If you need an intermediary, ask about an FMLA ombudsperson, who might be able to intercede and clear things up BEFORE it becomes a firing/penalty situation.
