In 2007 I tried to refinance my home because of the arm I had and twice when my credit was pulled it had BAD information on it. I was unable to refinance. In July of 2008 I lost my job and I gave my home back to the bank because I could not make the payments any longer, I borrowed from my 401 which I now have to pay tax on.

Since you do not pose a question, I will assume the question is whether or not you have a FCRA claim because of the inaccurate information on your credit report that resulted in being unable to refinance.

The very first thing you must do is file a dispute with the credit reporting agencies when you find inaccurate information on your credit report and give them a chance to fix it. If you take the proper steps, you may have a FCRA claim. However, if you have not attempted to have the information corrected, you will not have a claim.
