Are you talking about a Summons and Complaint suing you for unpaid medical bills, i.e., a collection action? You need to hire a lawyer to ensure your rights are protected. Are the damages sought by the plaintiff accurate, or is the dollar amount too high? If you agree the debt is outstanding, then you should negotiate a payment plan and resolution of the case, without going through litigation. Any such resolution should be placed in writing - always.

Your Answer and Affirmative Defenses to the Complaint are due within 21 days if you were personally served, and within 28 days if you were served by mail. Your Answer & AD must be filed with the Court and served on the plaintiff's attorney.

If you have substantial other debts, and do not have the means to repay your creditors, then you should consider bankruptcy. If you want to hire a lawyer to assist you with either the collection action and/or the bankruptcy, please feel free to contact me to discuss in more detail, and the legal fees. Thank you.
