Legal Question in Civil Litigation in Michigan

First small claims court

My husband and I have recently served our neighbors with small claims paperwork. The damages are from a damaged fence pole that she hit with her vehicle and 1/2 the cost of our fence that we had installed due to her almost damaging our home with her vehicle by driving so close. We were going to let the fence go but our neighbors have recently attached a gate to our fence that we purchased. We received a notice to appear on the same day as our court date, with our neighbors not the plaintiffs, and the wife has asked for loss wages for her husband who has to take the day off to attend the court hearing. Prior to our small claims paperwork, we attempted to resolve the issue with them, with no resolution. We then contacted our local building dept to see if we could get them to take off the gate from our fence, they advised us to call the police dept and get a report and then take it to court. So that is where we are at. My question is, would our neighbors be able to get loss wages for appearing in small claims court for less than 2 hrs, their claim is for $252.00. We would really appreciate any help you could give us, as this is all new to both my husband and I. We just want to be prepared for this case.

I wouldn't lose any sleep over their request for wages. It will almost undoubtedly be denied. I also am glad that I don't live in your neighborhood. William S. Stern
