Legal Question in Civil Litigation in Michigan

Sued for car that was sold.

I bought a brand new car and sold the car I had to my ''husband''. At the time I was in the process of filing for divorce. He had another girlfriend he was ''staying with'' even though his address was our apartment. I had the license plates off my ''old'' car transferred to my ''new'' car so the old car had no plates in my name. This all happened in the beginning of 2001. Earlier this year (2003) I got a collection notice of $872.00 for towing and storage of my old car. It was towed from my exhusbands girlfriends apartment complex. They said he never transferred the title so I owe them the money. They also have a licence plate listed that I have never heard of. They are now suing me for the money. Do I have a chance at court? I have a copy of the signed title. I am a single mom of 3 and have no money to pay this but I don't want to have a judgement if I lose. I have not heard from my ex in over a year. I don't know if he's alive or dead to even ask him to take responsibilty, not that he would. What should I do?

I believe that the state records determine ownership. The reason the title was not transferred is because he did not want to pay the tax. You're probably stuck, although you could sue your ex in small claims court. Collection may be a problem if you can't find him. Bill Stern
