If your husband entered illegally, then you will have to file a provisional waiver. If approved, he will need to be interviewed at the U.S. Consulate in Mexico. If his case is denied, he will not be able to return to the United States for potentially 10 years, depending on how long he has been living in the U.S. unlawfully since his 18th birthday. Therefore, you really should hire an experienced & reputable immigration attorney to assist you with this case (do not go to a Notario!).

Good luck!

With all due respect to counsel, whether or not he is eligible for the provisional unlawful presence waiver and even needs it is unknown based on the facts presented. We haven't been given his date of entry which may qualify him for adjustment of status pursuant to INA 245(i) and he would not have to depart. Or he may have entered and departed and then reentered in which case he's not eligible for an I-601A waiver. Please discuss fully with counsel because as you can see there are facts of consequence which must be discussed.
