Legal Question in Immigration Law in Michigan

H4 stamping in other than your native country!

Hello law gurus,

My fiancee and I both legally live in USA. I hold F-1 status, and he has H-1. I am a citizen of European Union, and he is a citizen of India. After beeing together for 3 years we finally are getting married in July, 2005. After the marriage i already will be a college graduate and would like to become his dependant and obtain H-4 status. My question is: after we get married, and the change of status gets approved by BCIS could i go accross the border to Canada and get my passpost stamped there? Is it perfectly legal, or are there any risks involved that i will be denied the visa and not allowed to re-enter USA? Or is it a must that i have to go to the country i am a citizen of to get my passport stamped there? The reason i want it done, is that we are travelling to India next Christmas and i would like to get my passport stamped before i leave for that trip, as we are planning a busy trip which will also be short, and i don't want to waste the time going to consulates in India to get it stamped. Looking forward for your response at your earliest convenience! Thank you so very much for taking your time and reading this post!

Re: H4 stamping in other than your native country!

Thank you very much for your inquiry. Whether you can get your passport stamped in a country other than your home country (which I am not clear on what that country is) depends on numerous factors including citizenship of which country, reasons for traveling to another country, etc. Please call us for a consultation. Ask for Rupali at (248) 619-0065. Thank you and congratulations on your engagement.
