Legal Question in Immigration Law in Michigan

Losing Green Card for criminal defense

In an attempt to discipline my out of control 15 year old son after he punched me, I hit him back. When he continued to threaten me I slapped him. He filed charges for 1st degree assault and battery (Domestic Violence). My criminal defense attorney wants me to accept a plea deal for a charge of 1st degree assault & battery (without the DV charge). I have held a green card for almost 20 years now and my attorney indicated that accepting this plea deal would not impact my immigration status, however if I was found guilty of the DV charge it would. I don't want to accept a plea deal and still have immigration problems. Is her advice sound. I live in the State of Michigan and am a citizen of Mexico.

Re: Losing Green Card for criminal defense

Your question sir is a complicated one. Your sentence should be less than one year. Also, I would need to know the statute you are pleading to. I suggest that you contact an immigration lawyer.
