Legal Question in Immigration Law in Michigan

If I marry my American fiance, how do I apply for a green card? I am on a three month Visa Waiver from Ireland. Can I remain in the States after I get married while I am waiting for my Green Card to be approved? I dont want to be deported if possible while I wait!

You might be able to apply for a Green Card through a process called "adjustment of status" while being petitioned your US citizen husband. Being on a visa waiver makes your situation somewhat vulnerable, but not impossible.

You should be able to do what is commonly referred to as a one step which is your U.S. citizen husband petitioning for you and you would file the application for green card and work authorization at the same time as the petition. Here in Michigan that would take approximately 4 months to adjudicate your case. You must be married first and yes, you would be able to stay here during that time. In very rare circumstances, a person on a visa waiver will be detained but that usually occurs if the visa waiver is expired and they have not filed anything in the way of the petition by a U.S. citizen spouse.
