9 years working as waiter on 10.99 tax forms never got w-2 can sue the owner and if yes any compensation migh occur?

Although the determination regarding whether a person is an independent contractor or an employee is fact-specific, it is highly unlikely that a waiter is truly an independent contractor under any circumstances. If you have been misclassified, you are entitled to all the rights you should have had as an employee, including the right to overtime pay.
