Legal Question in Employment Law in Michigan

hurt

Is it right that a employee can be fired for getting hurt on the job and if not, how come nothing cant be done about it. Or why is it ok for a employer, is able to fire you for any reason like what your wearing, what your driving for any thing like that.

thank you

Re: hurt

It depends on the facts and circumstances of the injury.

For example, if someone is hurt while horsing around on a hi-lo, that's not a firing on account of the injury, it's firing on account of the horsing around. That certainly falls within the valid "any reason or no reason" at-will employment boundaries.

If, however, the employee is fired and the injury is no fault of his own, and the clear objective is to avoid benefits payments, then it's a violation of worker's compensation law, and you need to file a wrongful denial of benefits claim. coupled with an illegal termination claim.
