Job Termination Question

I signed a contract for employeement for 2 years since I was given a relocation package. I would not have pay anything back if my job was terminated, or company down sized. It was announced last month that our facility would shut down and I was told that I could get a job in the MI facility if they had an opening. I found another job and now the company is requireing me to pay back the money for relocation. Do I legally have to pay it back since they announced the closure of our facility. I was told that the facility that I would be transfered to is also for sale and I could be in the same situation once I move up there. I am just wanting to know if I can fight this. The company feels that I am leaving voluntary since we are not shutting down until December and are requireing me to pay back almost the full amount since I have only been employeed for 5 months. I was not aware of the selling of the companies when I hired on and I actually hired on under another company name and found out during my orientation that I would become a ''leased'' employee to my current company and not affiliated with my company I originally hired on with. Has my contract became void due to all of this?

I take it you are now a Kansas employee? One would have to look at your agreement to answer your question with any certainty. In any event, the company would have to sue you to get the money back and that might cost more than it is worth. It should not be legal for them to withhold your wages in order to compensate themselves. You could report that to the Kansas department of labor.
