Non-Paying Tenant - Says he's moving out

I have a tenant of 6 months who has not paid one rent payment on time. The house is in Michigan, but I live in Georgia, making it very difficutl. He decided to vacate my home by June 30th. It is now July 3rd and he still is not out.

The electricity was disconnected due to non-payment on June 21st and the refrigerator is full of food and emitting a terrible odor. My real estate agent noticed this with a visit to the house, when the tenant was supposed to meet her there for an inspection.

I have not filed a legal eviction as he said he was moving out by his choice. I really wanted him to just pay me on time.

Can I go in the house and clean the refrigerator and trash from the garage? Do I have any rights to move his belongings out of my house? Should I still file for an eviction? Since he is not living at the house, what will happen if we can't serve him? He currently owes me $2185.00 in past rent, will I be able to collect on the remaining 6 months of the lease, since he decided to leave?

Unless your lease contained a clause in which your tenant agreed that the law of Georgia would apply to disputes under the lease, you will need to consult a Michigan attorney.
