Legal Question in Landlord & Tenant Law in Michigan

Recovery of Rental Deposit from Estate in Probate

my daughter's landlords died, daughter sold the propery, then family members have contested the will and all other properties put thru probate court. In the meantime, my daughter was forced to move from the property and has yet to receive her deposit back - daughter claiming part of the estate process and 'didn't know about it until she called her 2 months ago' - what can we do? Isn't the executor or someone required to pay the estate bills even if in probate?

Yes, the person handling the estate is required to pay debts out of the estate, but it may not have gotten that far yet. If you know who is handling the estate, contact that person and put your request in writing indicating that you are owed a debt of X amount and what it is for.
