Wrongful Evictions

If a tenant has a marijuana case that is 2 years old, that did not occur on the grounds of any rental property (goverment funded), can the housing commission of that city evict that tenant on the MCL 600.5714?

The defense is that the eviction is illegal because as per the statute, the violation did not occur ON the leased premises and the LANDLORD did not file the police report.
