trust account

we sued in civil court and the defendents attorney had the money in dispute in his trust accout. the case has been settled and the attorney had returned the money to his client instead of us. is this legal?

If there was a court order to hold the money in escrow and you received a judgment or settlement that was put on the record in open court and then the money was not paid to you, then you can raise it before the trial judge. Otherwise, you will have to take the settlement order (hopefully it was reduced to writing) and have it entered as a judgment in court. Then, after waiting the appeal period (normally 21 days in Michigan), you can file a writ of execution with the court officer who will start the attempt to turn that piece of paper into money.
