Legal Question in Medical Malpractice in Michigan

facial surgery

i have had two facial surgerys by the same doctor within one year from the other. the second was to correct the error he had made from the first. first was feb.97. second was mar.98. the second surgery left me with more errors then first. when i returned to the doctor he told me the dark purple line going from ear to corner of me mouth was caused by having to reopen which caused blood to get inside face. i waited another year and a half hoping most would go away. but of course it didn't. he had told me he could maybe help me! i told him i would go to another doctor for a second opinion. went to another doctor, still waiting to see what he can do for me. it sounded like second doctor didn't want to admit to any errors the first doctor had done. i would like to know what my timeframe is for any legal action. and i would also like to know i would contact the doctors malpractice insurance company.

Generally, the period of limitation to bring a medical malpractice action is two years. The time period begins to run at the time of the act or omission that is the basis for the claim of the medical malpractice regardless of the time the plaintiff discovers or otherwise has knowledge of the claim.

However, there are exceptions to this general limitation including fraud, reproductive system injuries, minors and malpractice which results in the death of the patient.

Please consult an attorney immediately to determine whether or not any of the exceptions to the general two year period of limitations applies to your case.
