Even assuming there was malpractice (which is definitely not a certainty), there is not enough damage on which to base a malpractice case. Malpractice cases are extremely expensive to pursue so the damages must be very great in order to merit the financial investment. A jury would not return with a large enough verdict to merit the potential investment. A lawyer who knows what he or she is doing does not pursue a medical malpractice case in order to extract a settlement. When you start a malpractice case, be ready to take it all the way through trial and beyond (appeals). This involves the potential of years of work and litigation.
