Damage caused by motor vehicle accident

Our car was totalled after a vehicle two cars behind us failed to stop on the highway. It totalled our car and the insurance is paying all but $750 of the loan we have on the car. Is there a way to retrieve funds from the cited driver to cover this or are we just out of luck due to someone else's inattention?

You can always sue in small claims court where parties represent themselves. Make sure you have fully negotiated the amount to be paid with your insurance company. You do not have to agree with your insurance company's assessment of your car's value and you should negotiate to your satisfaction. Also, any deductible you are responsible for should be paid by the insurance company of the party at fault.
