Legal Question in Personal Injury in Michigan

Someone I know may be driving illegally. The organization he works for has a vehicle requiring a CDL class C license and a P endorsement. If he's caught, I already know that he'd receive a ticket and his company's vehicle could be impounded. My question: If he was driving without the correct license, and say was involved in an accident, would that organization be liable? Also, would his passengers at that time have a case for making a law suit if they we're injured?

If he is driving for work, and at the time of the accident, he IS working, his employer is liable for any injuries/damages.

If his passengers are part of his employment (ie he drives a bus and they are a bus passenger) the passengers always have a case against the carrier.
