injured on pool slide

we just bought our house this year. the pool had a slide, my son was going down the slide and it broke apart as he was going down. he recieved 20 stitches and missed out on his hockey rep tryouts. is the pool slide company responsible? we have already sent them a letter, they have not reponed

You may have a case but it is far from clear. You need to know why it broke apart. Also, are the parts still available? If not, you could be precluded from bringing a claim. There are issues regarding what is called the statue of repose (getting rid of cases involving old stuff). If it broke apart due to weather, etc., they will also allege a duty of inspection, etc. Improper installation could also be a defense. My point is, these cases are very difficult and no one brings them unless the damages are great because the obstacles are great. William S. Stern
