Legal Question in Personal Injury in Michigan

A teacher at my son�s daycare actually sat on my sons back while he lay in his cot because he wouldn't lay down. I'm taking him to our family doctor in the morning to see if he has any back injury. A few more kids witnesses this occur during nap time, they awoke when my son screamed out. He is 4 years old. My wife is going to talk to the administrator in the morning. Could I have a case if the teacher is fired and or he has trauma to his back?

I would say yes, if you actually get a doctor to diagnose that and it came from trauma. The biggest hurdle here is you have a lot of 4 year olds as witnesses, who are unreliabke by nature. As Tim indicates, it depends upon the severity of the injury. But, more importantly, this man should be reported to whatever government authority regulates and licenses daycare centers. He should not be watching or caring for children.
