Drainage Ditch Blocked by Neighbor

I have owned my property for over

twenty three years. There has

been a ditch that runs through my

property and the neighbors into a

county drain. Within the last year

or so the neighbor (who purchased

the property eights years ago approx) blocked the ditch in two places which is causing water to

stand in the ditch on my property.

Do I have any legal rights since my

property and his were tiled to drain into that ditch?

The best thing you two can do is mediate your dispute. Why?

Because it is a low-cost way of working this out and you would be wasteful to drag something like this out in court with someone you will be living next door to for a long time to come. You can probably spend one afternoon and the cost of *maybe* a few hours of attorney time and get it worked out.

Legal rights are one thing, but what happens in real life is entirely another: you need to resolve the dispute, not fight about rights.

There are wonderful mediation centers throughout Michigan with experience helping people sort out this type of problem.
