Legal Question in Real Estate Law in Michigan

jane doe got the house in her divorce.

Jane remarried. Home is in her name alone. Jane wants to refinance her home in her name only. Morgage company says she has to add her current husband to the new mortgage due to Michigan dower rights. I thought dower rights protected the wife only. Does jane have to put her current husband on the new mortgage?

Yes, but not the note. A huge difference. The married partner must sign the mortgage, which is the lien on the property. The note is the promise to pay. Very standard request. www.kliszlaw.com. Tim Klisz
