Legal Question in Real Estate Law in Michigan

Property Deed

In the state of Michigan, what would be the wording used on a quit claim deed to transfer property from a husband to his wife by way of a Durable Power of Attorney, so that the property passes directly to the wife, and bypasses probate? The wife was granted Durable Power of Attorney by the husband, before his illnes.

Re: Property Deed

Generally speaking you will need language indicating that the transfer is to be joint with rights of survivorship and that the Grantor is wife with power of attorney to act on husband's behalf.

I do not know the specifics of your situation and am only discussing general principles of law. This information is not to be relied upon and does not create an attorney-client relationship.

This is something you should have an attorney do for you. If you would like me to do so, please contact me at www.lawrefs.com.
