Legal Question in Real Estate Law in Michigan

Property Issue

I moved out of an apartment I had with a friend, and they moved out a month later. They would not return my phone calls and changed the locks on the doors, but have since moved. upon moving, they consented to the apartment complex to remove my Items that I had been trying to recover and throw them away. The items values total over $1000. Would I be able to take them to small claims court? What would I need to do to have my losses credited?

Re: Property Issue

The court would want to know why you did not take action earlier to obtain your personal belongings. You could have contacted your local police department to have an officer escort you to the apartment to retrieve your items. You could have also informed the apartment complex that you had personal items in there that you needed to retrieve.

You could file suit, but I'm not sure you'd be successful given the above questions that the court would look into. Plus, you'd have to prove the value of all of your items, which would be hard, since they are all gone and you'd need receipts or photos of all your items to prove their value (and your former roommate would argue the items were not worth as much as you said).
