Me and my husband , were purchasing a house we gave an legitimate realestate broker from keller willams properties the amount of 10,000 cash. well my husband passed on a month later. I've recieved about 3000 dollars with the balance of almost 7500 dollars. I have alll paperwork and reciepts for moneys recieved is it possible i can sue him in small claims court? is it also possible i could sue for punitive damages as well?

It is difficult to tell from all facts given the entire situation. If you provided $10,000 for an escrow deposit on a home purchase and the deal was not completed the seller would have been required to sign a release of the funds to have them returned. By law a broker is required to place the funds given for an escrow into a trust account within 48 hours. If the agent has earned part of the funds they may be entitled to it, however this situation will be very dependent on the paperwork and facts beyond what has been given. I would encourage you to contact a real estate attorney and have a consultation with them and have all of your paperwork reviewed. In addition, a small claims action in Michigan is limited to recovery of $3,000.
