Legal Question in Real Estate Law in Michigan

Stolen Property

I moved out of a house and left some things there and the people who moved in set my 200 gallon fish tank on their porch and someone stole it. Can I sue them?

Re: Stolen Property

You can sue the persons who stole the property, but unless you left the property there with consent and an agreement with the people who moved in, you can't sue them, as they would be under no duty to exercise care of your personal property and would have every right to remove it from the home.

Re: Stolen Property

A court would likely determine that you had abandoned the property unless you can prove you had an agreement with them that they would hold onto your property for a certain amount of time and failed to do so, or failed to take reasonable care to protect it by placing it outside where someone could steal it.

If you know who took it, go after them. If you don't, you should probably not waste your time going after your former roommates.
