Can I sue Real Estate Agent for neglegence. I rented a home through the agent after agent confirming credit of the tenents. She was 100% wrong and it costed me $4000 in legal expenses and $16000 in lost rent. The first check collected by the agent for security deposite and first month rent bounced.

Re: Can I sue Real Estate Agent

You very may well have a cause of action against your agent depending on the terms of your contract with him/her and whether or not she timely notified you that the checks had bounced, etc. The amount you could actually recover again depends on the terms of the contract and whether your agent was truly negligent in verifying their credit, (i.e., what steps was she supposed to take, what did she actually do, should she have discovered something regarding their credit had she properly performed her background check, etc.) There are a lot of facts that would have to be reviewed before providing you with a more complete legal analysis and opinion.

If you'd like to retain me to review your contracts and discuss the facts with you, please contact me.

Thanks.
