Legal Question in Traffic Law in Michigan

I was issued a ticket today, 12/2/10, and the citation is for 11/4/10 when a car passed a school bus with the redlights on. I do not believe I commited this offense, but have no alibi as to where I was at the time. The officer came to my house about a week ago telling me he was investigating. Now he has writtten me a ticket. I am going to fight it, but not entirely sure what that entails or what I should prepare to say or do. Any help with this would be greatly appreciated.

Thank you.

My practice includes auto negligence and therefore do not practice much criminal law, however that being said, I am familiar with most tickets and have fought many for family members and clients. I believe this is a fairly serious ticket and you should find out how many points it is and what did Dollar amount potential fine could be.

- There are two different kinds of hearings: an informal hearing will be in front of a magistrate and it will be EU versus the police officer. The police officer will state his case and evidence and you will have to respond. Typically there is no place or opportunity to cut . If you have an informal hearing and loose you can appeal and request a formal hearing thereafter.

- The second kind is a formal hearing. Read your ticket and you can request a formal hearing where you are able to talk to a prosecutor before going into court, plead your case/show your evidence and the prosecutor can choose to dismiss or cut a deal. It is in front of a judge.

- I recommend hiring an attorney that is familiar with that District Court. This is the type of ticket that will raise your insurance premium rates
