Legal Question in Traffic Law in Michigan

police radar set-up

do the police have the authority to set-up a speed trap on private property; ie; in a parking lot of a golf course? AND next question;; can one patrolman set-up on a freeway overpass, use a radar or laser on traffic, and then have another officer, who did'nt witness the vehicle speeding issue a speeding ticket? Seeing as this is essentially a misdemeanor, would'nt the originating officer have to come down and cite you for the violation?

Re: police radar set-up

Both of the "setups" sound legal and are a very common practice. And most likely your ticket was a civil infraction, and as long as one officer witnessed your traffic violation, that is sufficient to give you a ticket. I would suggest you retain a lawyer to negotiate a deal with the prosecutor to get a no point violation so your insurance does not go up.

Thanks.

Yes, ...Yes!....and ...No. Where did you get the idea it's a misdemeanor?.

speesing is not a misdemeanor, it is a civil infraction. Secondly, speed traps have been found to be legal. Visit www.kliszlaw.com if you would like to fight your ticket. Tim Klisz
