Legal Question in Wills and Trusts in Michigan

My brother passed away unexpectedly and had no will. He had a live in girlfriend who's name is not on the property or any of the vehicles. One of the vehicles is being driven and paid for by a daughter of an ex girlfriend that was raised as one of his own. As the only surviving next of kin, do I have the right to take the vehicle away and evict the live in girlfriend?

You do not have any authority until a probate estate is opened in the County Probate Court. If you are appointed personal representative, you will have control over any assets in your brother's sole name. You may also be an heir, if your brother was not married, had no kids and no parents alive. Please contact me if you would like to discuss this in further detail. 586-580-8850 or [email protected]
