Legal Question in Wills and Trusts in Michigan

Estate of deceased Mother

My mother passed away in April of 2005 and her house sold in Aug. of 2007. My sister who is the executor of the estate has yet to inform the rest of us (there are 4 other offspring) about the assets of her estate. How long can she keep the estate open and how long do we wait?

Re: Estate of deceased Mother

Assuming that she opened a probate estate and that this is not a trust administration, she is supposed to send an inventory of all estate assets within 90 days of opening the estate to all heirs / beneficiaries. The same rules apply to the administration of a revocable living trust. If it is an irrevocable trust, she is obligated to follow the terms of the document. In general, it seems to me that the odds are very high that she is not in compliance with the law. Irrevocable trusts are fairly rare.

If the case is in Probate, this seems very long. The real estate can hold up administering probate, but not if sold. You should probably hire an attorney to look into this matter and represent your interests as heir. I can be contacted at www.kliszlaw.com for a free discussion on this matter. Tim Klisz

I have discussed the topic of accountability of executor at my website www.lawrefs.com under the probate / estate section. You will find this information very relevant to your inquiry. Good luck and let me know if you have any further questions.
