Legal Question in Wills and Trusts in Michigan

Who get the estate?

My father is dying, my Grandma is his legal guardian and won't let him get chemotherapy because she thinks his estate is going to her and she needs his money. Does she get his estate or is it divided among his children. There is no will that I am aware of.

Normally, you would get the money, unless he had a wife. If he had a wife, then the wife would get the first $150,000 and the remainder is split between the wife and kids. However, I would bet that if he has money, it is in one or more joint bank accounts with the grandmother. If so, it is quite possible that upon his death, the money in any such accounts would go automatically to the grandmother. Money in joint accounts with rights of survivorship bypass probate and are not dealt with by wills. Bill Stern 248-353-9400
