what are the legal steps to keep a exector of a estate from cashing in all the assets of the estate when there is no will and things have not gone into probate?

retain a probate/estate attorney to open an estate - most likely a supervised estate so that the court has to approve all the proceedings, distributions, division of assets, etc.
