Executing of the will

My Mom died in 2001, one of my brothers, who is the executor, has yet to do anything about the will, which designated that that we 3 children would split the antiques they had. How long can he let the will just lie there and do nothing? What can I do to encourage him to fulfil the will?

Re: Executing of the will

In most states a court procedure is available to require the executor to complete the administration of the estate or be removed from serving as executor. In California after a person is appointed as executor they are required to file an inventory and appraisal of all the estate assets within 4 months of appointment.
