Legal Question in Wills and Trusts in Michigan

How do I find out if a trust was left to me?

My father died in November of 2001. My brother was executor of the estate. I found out last summer via my sister that my brother told her that I was to receive a trust fund. Apparently he called her asking for my phone number to give me the information. He has of yet to give me information on the fund and when asked about it, looks at me blankly and says ''I'll check on it''. I know that other items of the will have already been distributed, so it isn't in probate.

How can I find out if I have a trust fund without involving my brother?

A good start would be to check with the probate court in the county where your father last lived. If a probate proceeding has been started the documents will tell all.

There may not be a way to find out the information you seek without involving your brother. One possible way is to see if the "trust" fund was created by your father's will (check your copy if you have one or check the probate court if a probate estate was opened). If you have no information whatsoever, the only other practical option is to confront your brother directly and with the possible threat of legal action if he fails or refuses to disclose any information related to the trust. These are matters that our firm handles regularly and on an hourly-basis. If you wish to pursue the matter further, please feel free to contact Pat Prince or Shaheen Imami at 248.865.8810. Good luck.
