Legal Question in Wills and Trusts in Michigan

Ex husbands will

Before we got married, my ex husband had a will made out that entitled me to 40% of everything. This will was made out in the early 90's. We got married in 1998 and divorced in 2006. He past away 4 months after the divorce. Is this will null and void now that we're divorced?

Re: Ex husbands will

You will probably have a battle on your hands, but the will stands unless and until he changed it or something in your divorce made it not apply.

If you want to claim a share and there are others who feel entitled to the money, get a good lawyer.

Please try to mediate it, though. This is the sort of thing that can quickly eat up an estate, and cause nothing but increased anger and stress in the wake of someone's death.

Contact Wayne Mediation Center,--if they can't help you, they can point you in the direction of a mediation center that can. Also, the Michigan Bar has a fantastic panel of local mediators, who can do it as well.
