is lawyer doing what he is suppose to

my father past away and and we hired a attorney who does probate but it has been over 3 weeks and we still dont have a court date for conservator ship. And he has asked for money also is that normal? Doesnt he just bill the estate. Also what rights does the x-wife have they have a daughter who is 13.

Depending on the Court's schedule, it could be anywhere from 3-6 weeks before a hearing takes place. Note, however, that certain estates can be opened without having a Court hearing. It is not unusual for an attorney to take a retainer fee in a situation like this. This does not preclude you from being reimbursed from the Estate at a later date if the Court approves the fees. The ex-wife does not have any rights in this Estate. However, the 13 year old daughter does.
